This Privacy Policy (“Policy”) describes the policies and procedures on the collection, use, disclosure and protection of your information when you use our website located at Nearle .in, or the Nearle mobile application (collectively, Nearle Platform”) made available by Nearle Technology Private Limited(Nearle ”, “NEARLE”, “Company”, “We”, “Us” and “Our”). The terms “You” and “Your” refer to the user of the Nearle Platform. The term “Services” refers to any services offered by Nearle whether on the Nearle Platform or otherwise. Please read this Policy before using the Nearle Platform or submitting any personal information to Nearle. This Policy is a part of and incorporated within, and is to be read along with, the Terms of Use.

SECTION 1 – YOUR PERSONAL INFORMATION

When you sign up on the Nearle app, as part of the buying and selling process, we collect the personal information you give us such as your name, address, phone number, email address, gender and date of birth. We also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. Emails, Whats App Messages and SMS: With your permission, we may send you emails, Whats App messages and SMS messages about our store, new products and other updates.

SECTION 2 – CONSENT

How do you get my consent? When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. In order to enhance the user experience and provide Our Services, Company collects information about You: (a) information You affirmatively and voluntarily give to us; (b) information automatically collected when You visit Our Platform or use any of Our Services; and (c) information we receive from other sources

(a) Information you give us

This includes information submitted when you:

  • Create or update your Nearle account, which may include your name, email, phone number, login name and password, address, payment or banking information, date of birth and profile picture.
  • Provide content to us, which may include reviews, ordering details and history, special merchant requests, contact information of people you refer to us and other information you provide on the Nearle Platform (“Your Content”).
  • Use our Services, we may collect and store information about you to process your requests and automatically complete forms for future transactions, including (but not limited to) your phone number, address, email, billing information and credit or payment card information.
  • Correspond with Nearle for customer support;
  • Participate in the interactive services offered by the Nearle Platform such as discussion boards, competitions, promotions or surveys, other social media functions or make payments etc., or
  • Enable features that require Nearle access to your address book
  • Report problems for troubleshooting.
  • If you sign up to use our Services as a merchant or a delivery partner, we may collect location details, copies of government identification documents and other details (KYC), call and SMS details.

(b)Information we collect about you

Regarding each of your visits to the Nearle Platform, we will automatically collect and analyse the following demographic and other information:

  • When you communicate with us (via email, phone, through the Nearle Platform or otherwise), we may maintain a record of your communication;
  • Location information: Depending on the Services that you use, and your app settings or device permissions, we may collect your real time information, or approximate location information as determined through data such as GPS, IP address;
  • SMS Permissions: Used to streamline user authentication by automatically detecting and verifying one-time passwords (OTPs) during login or registration processes.
  • Transaction Information: We collect transaction details related to your use of our Services, and information about your activity on the Services, including the full Uniform Resource Locators (URL), the type of Services you requested or provided, comments, domain names, search results selected, number of clicks, information and pages viewed and searched for, the order of those pages, length of your visit to our Services, the date and time you used the Services, amount charged, details regarding application of promotional code, methods used to browse away from the page and any phone number used to call our customer service number and other related transaction details;
  • Device Information: We may collect information about the devices you use to access our Services, including the hardware models, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information and mobile network information.
  • Stored information and files: Nearle mobile application (Nearle app) may also access metadata and other information associated with other files stored on your mobile device. This may include, for example, photographs, personal contacts and address book information. If you permit the Nearle app to access the address book on your device, we may collect names and contact information from your address book to facilitate social interactions through our services and for other purposes described in this Policy or at the time of consent or collection.
  • SMS Permissions: Used to streamline user authentication by automatically detecting and verifying one-time passwords (OTPs) during login or registration processes.

(c) Information we receive from other sources

  • We may receive information about you from third parties, such as other users, partners (including ad partners, analytics providers, search information providers), or our affiliated companies or if you use any of the other websites/apps we operate or the other Services we provide. Users of our Ad Services and other third parties may share information with us such as the cookie ID, device ID, or demographic or interest data, and information about content viewed or actions taken on a third-party website, online services or apps. For example, users of our Ad Services may also be able to share customer list information (e.g., email or phone number) with us to create customized audience segments for their ad campaigns.
  • If you are partner, merchant or a delivery partner, we may, additionally, receive feedback and rating from other users.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which these providers will handle your personal information. In particular, remember that certain providers may be located in the city you live in or have facilities that are located at a different jurisdiction and legal proceedings are subjected according to their policies. You expressly consent to the sharing of Your information with third party service providers, including Merchants, insurance agents and insurers, financial service providers, payment gateways, to process payments and manage payment card information. Company does not itself store Your payment card account information and does not have direct control over or responsibility for Your payment card account information. Hence, Company cannot guarantee that transmissions of Your payment card account information or personal information will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by Company or Company’s third-party service providers. Company assumes no liability or responsibility for disclosure of Your information due to any reason, including but not limited to errors in transmission, unauthorized third-party access, or other causes beyond its control. Although we shall try our best to protect Your data, we cannot take any guarantee for the security of Your data transmitted through the Platform. You play an important role in keeping Your personal information secure. You shall not share Your username, password, or other security information for Your account with anyone.

We use cookies to maintain session of your user. It will not be used to personally identify you on other websites.

SECTION 8 – USE OF PERSONAL INFORMATION

The information collected by Us through our Platform maybe used for the following purposes:

  • To allow You to use Services on the Platform;
  • To allow You to undertake or initiate any transactions on the Platform
  • To improve our Services;
  • To improve Your usage of the Platform, to manage Your Account, etc
  • To process payments with respect to transactions initiated on the Platform;
  • To respond to Your comments, reviews and questions and provide better Service;
  • To communicate important notices or changes to the Services provided by Company on the Platform, use of the Platform and the terms/policies which govern the relationship between You and the Company;

From time to time, we may use Your information to customize, develop, improve the Platform according to your interests

We may use personal information to resolve disputes that may arise with the use of Our services on the Platform, help promote a safe service to You on the Platform, measure consumer interest in Our services, customize Your experience, detect and protect Us against error, fraud and other illegal activity, enforce Our terms and conditions.

We identify and use your IP address to help diagnose problems with our server, and to administer our Platform. Your IP address is also used to help identify You and to gather broad demographic information

We shall be entitled to retain Your Personal Information for such duration as may be required for the purposes specified hereunder and shall be used by Us only in consonance with this Privacy Policy

SECTION 9 – SHARING OF PERSONAL INFORMATION

We share Your information with third parties and third-party service providers including Merchants or insurance service providers upon receipt of request by You to initiate a transaction to carry out specific service requests and fulfil such service requests.

We may also share your information with payment service providers for the purpose of fulfilling Services to you. We may disclose Your personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to enforce our Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our Users or the general public.

Any content or personal information that You share or upload on any current or future publicly viewable portion of the Platform (on discussion boards, in messages and chat areas, etc.) will be publicly available, and can be viewed by others.

If You provide a mobile phone number and/or e-mail address, the Company, or other parties registered on the Platform may call You or send You communications in relation to Your use of the Platform or Your any transaction initiated by You on the Platform. We and our affiliates will share/transfer some or all of the collected information (personal or otherwise) with another business entity should We (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business, in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction or proceeding.
